DMCA Policy

Effective Date: April 2, 2026

BlipVibe LLC ("BlipVibe," "we," "us") respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (17 U.S.C. § 512) ("DMCA"), BlipVibe will respond expeditiously to claims of copyright infringement committed using the BlipVibe platform (the "Service").

1. Designated Agent

BlipVibe's designated agent for receiving DMCA notices is:

BlipVibe has registered its designated agent with the U.S. Copyright Office.

2. Filing a DMCA Takedown Notice

If you believe that content hosted on BlipVibe infringes your copyright, you may submit a written notification to our designated agent containing the following:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  2. Identification of the copyrighted work claimed to have been infringed (or, if multiple works are covered by a single notification, a representative list).
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity, and information reasonably sufficient to permit BlipVibe to locate the material (e.g., the URL of the content).
  4. Your contact information, including name, address, telephone number, and email address.
  5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement, made under penalty of perjury, that the information in the notification is accurate and that you are authorized to act on behalf of the copyright owner.

Important: Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages, including costs and attorneys' fees.

BlipVibe reserves the right to reject or ignore any notification that does not substantially comply with the requirements of 17 U.S.C. § 512(c)(3).

3. No Prior Screening

BlipVibe does not pre-screen user content but reserves the right to remove any content that violates this policy or applicable law.

4. How BlipVibe Responds

Upon receipt of a valid DMCA takedown notice, BlipVibe will:

If you believe your content was removed by mistake or misidentification, you may submit a written counter-notification to our designated agent containing:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or disabled and the location where it appeared before removal.
  3. A statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if outside the United States, the United States District Court for the Eastern District of Tennessee), and that you will accept service of process from the person who provided the original DMCA notice or their agent.

Upon receipt of a valid counter-notification, BlipVibe will:

BlipVibe shall not be liable to any user for removal or disabling of access to material in response to a notice submitted in good faith pursuant to the DMCA.

6. Repeat Infringer Policy

BlipVibe maintains a policy to terminate, in appropriate circumstances, the accounts of users who are repeat infringers. Determinations are made based on multiple valid infringement notices and other relevant factors, at BlipVibe's sole discretion. BlipVibe may terminate any user's access to the Service if the user is determined to be a repeat infringer.

7. Audio & Music Content

Users are responsible for ensuring they have the necessary rights to any audio content uploaded to BlipVibe, including music. Unauthorized use of copyrighted music is prohibited and may result in content removal and account termination under our repeat infringer policy.

8. Standard Technical Measures

BlipVibe accommodates and does not interfere with standard technical measures used by copyright owners to identify or protect copyrighted works, as defined under 17 U.S.C. § 512(i).

9. Fair Use

BlipVibe does not make determinations regarding fair use and acts in accordance with the DMCA framework upon receipt of facially valid notices. Users who believe their content qualifies as fair use may submit a counter-notification as described in Section 5.

10. Modifications

BlipVibe reserves the right to modify this DMCA Policy at any time. Changes will be effective immediately upon posting the updated policy. Your continued use of the Service after changes constitutes acceptance of the updated policy.
